The O-1 nonimmigrant visa is for individuals who possess extraordinary ability and have demonstrated sustained national or international acclaim in sciences, arts, education, business, athletics, or the motion picture and television industry. You must be coming temporarily to the United States to continue work in your area of extraordinary ability.
To qualify for an O-1 visa, you must demonstrate extraordinary ability by sustained national or international acclaim. You must meet at least 3 of the 8 criteria listed below, or provide evidence of a major internationally recognized award (like Nobel Prize).
Receipt of nationally or internationally recognized prizes or awards for excellence in your field.
Membership in associations that require outstanding achievements for membership.
Published material about you in professional or major trade publications, newspapers, or other media.
Serving as a judge of the work of others in your field, individually or on a panel.
Making original scientific, scholarly, or business-related contributions of major significance.
Authoring scholarly articles in professional journals or other major media in your field.
Being employed in a critical or essential capacity for organizations with distinguished reputations.
Commanding a high salary or other remuneration for services compared to others in your field.
A U.S. employer or agent must file Form I-129, Petition for Nonimmigrant Worker, with USCIS.
Gather evidence for at least 3 of the 8 criteria, including expert testimonials and contracts.
Obtain a consultation from a peer group or labor organization in your field.
Once approved, apply for the visa at a U.S. consulate or embassy in your home country.
